How to Distinguish Separate Property from Community Property

Separate property

Separate property is property either spouse owned before the marriage or received during the marriage by gift or inheritance or in exchange for other separate property.

Community property

Community property is property acquired either or both spouses during the marriage unless the property was given to either spouse separately as a gift, inheritance or in exchange for other separate property.
